Mischief Under $5,000 Defence in Ontario

A practical response starts with the details.

A damaged phone, a broken door or an allegation of interference with property may become a separate criminal count. FLS assists with eligible mischief under $5,000 cases in Ontario, including related domestic files, after confirming the exact subsection and Crown summary election.

What is mischief under $5,000?

Section 430(1) addresses wilful property damage and specified interference with property or its lawful use. The usual “under $5,000” charge is associated with the property category in subsection (4). The statutory branch, property and prosecution route need checking; the number on a repair estimate alone does not answer every classification question. Read section 430(1)–(4).

A second charge in a domestic case

A file involving an assault or harassment allegation may also allege damage to a phone, door, household item or other property. Each count needs its own assessment. FLS considers the complete charging document, related disclosure and release terms so advice about one allegation does not overlook another. Read about domestic assault representation.

Damage and interference are different allegations

Mischief is not limited to a visibly broken object. Section 430(1) also addresses rendering property ineffective and specified obstruction or interference. Read the paragraph cited on the charge document and identify what conduct is alleged. A disagreement over property is not itself a finding that the statutory requirements are proved. See section 430(1).

Keep photographs, recordings and property records

Once intake and any conflict check are complete, we can explain how to provide the relevant material. Photographs, full message threads, video, ownership or access records and repair documents may help frame the questions for disclosure review. Keep original records; avoid editing an exchange or asking someone to change their account.

Shared property and practical arrangements

If the item or home was shared, explain the ownership and access arrangements to your representative. Do not assume that a partial ownership interest resolves the allegation. Also identify any restrictions affecting access to the home or collection of belongings. Obtain advice about the actual documents before arranging contact or returning to a restricted location.

Representation, fees and next steps

FLS confirms the precise count, Crown election, related proceedings and permitted scope before accepting representation. The written retainer identifies the agreed work, such as disclosure review, Crown discussions, court appearances or trial preparation. Ask about fees, HST and payment arrangements during your consultation. See the court’s guide to the process.

Common questions

Can mischief be charged together with domestic assault?

A prosecution can contain separate allegations arising from the same incident. Bring the whole charging document so the evidence, conditions and permitted scope for each count can be assessed.

Does mischief always involve physical damage?

No. Section 430(1) also addresses specified interference with property and its use. The exact paragraph and facts matter. Read section 430(1).

Does paying for repairs automatically end the case?

Do not assume a payment or private agreement ends a prosecution. Seek advice about the proposal, release terms and the intended outcome for every count.

Do you handle every kind of mischief?

No. Different subsections concern different types of property and circumstances. This page offers assistance with eligible mischief under $5,000 proceedings, not every offence within section 430.
