CLEAR ANSWERS

Questions are
a good place to start.

Understand the scope, the process and how to begin a conversation.

Can a paralegal defend a criminal charge in Ontario?

Yes, for certain offences within the permitted paralegal scope. The precise charge and the Crown’s election must be checked. A summary election alone does not make every offence eligible. See the Law Society’s permitted offences.

Can my partner have a domestic assault charge dropped?

A complainant can communicate their views, but the Crown decides whether to continue a prosecution. A request to withdraw does not automatically end the case or change a no-contact condition.

Can we speak if I live outside Durham Region?

Yes. Consultations are available virtually across Ontario, with in-person appointments in Durham Region by arrangement. Court attendance and representation depend on the matter, court requirements and the agreed retainer.

Will I have to attend court in person?

It depends on the appearance and the court’s directions. Some case management appearances may be virtual. Confirm each appearance with your representative; do not assume a consultation or retainer removes your obligation to attend.

How will I know what representation costs?

Your consultation is an opportunity to discuss the work your case may require. Before representation begins, you receive a written agreement setting out the scope, fees, HST and payment terms. Ask about payment arrangements when you contact us.

What does a summary election mean?

For a hybrid offence, the Crown chooses whether to proceed by indictment or summary conviction. It is not a procedure the accused can simply choose. A paralegal must also be authorized to act on the particular offence.

Do you handle all types of assault?

No. The precise offence must be checked. Our assault services cover eligible simple assault and domestic-related simple assault matters. More serious assault charges and indictable proceedings require a lawyer.

What should I send when I first contact you?

Start with your contact details and preferred language. Avoid sending a detailed account, evidence or identification before we confirm the appropriate intake process and any conflict check.

Does contacting the office retain you?

No. Contact or a consultation request does not create a retainer or guarantee availability. Representation begins only after the matter is accepted and the retainer arrangements are completed.

Which other criminal charges can FLS assess?

Explore our criminal charges and defence services, including eligible theft, shoplifting, mischief, fraud, possession, communications and release-condition cases. Exact charge, Crown election and permitted scope are checked before acceptance.

Are other legal services still available?

You can ask about other permitted paralegal and notary matters. This website’s main focus is criminal defence. Notary information is available through the existing Fast Legal Service website.
