THE COURT PROCESS

Your first criminal court appearance in Ontario

What to check, what to bring and how to prepare for the first date.

Begin with the date on your documents

Your appearance notice, undertaking, summons or release order contains important details. Check the date, location and any directions. Keep fingerprint appointments and court dates separate; one does not replace the other.

Ask about disclosure

Disclosure is the evidence and information provided by the Crown. It may include police notes, witness accounts and recordings. Obtaining it is a process, and additional material may arrive later. Ask your representative what has been received and what remains outstanding.

Understand the purpose of the appearance

A case management appearance usually deals with the progress of the case: disclosure, representation and preparation for the next step. Your first appearance is not automatically your trial. Specific procedures and scheduling differ by courthouse and court direction.

Confirm how you must attend

Virtual attendance may be available for some appearances, but requirements vary. Confirm the instructions for your own date. Do not assume a representative will attend in your place unless this has been arranged and is permitted.
