Identify the charge before the strategy

Simple assault under section 266 can proceed by indictment or summary conviction. A paralegal may represent an accused only within the permitted scope. Assault with a weapon, assault causing bodily harm and aggravated assault need a separate scope assessment and are not offered as paralegal services here.

Look at the evidence in context

Disclosure may include witness accounts, police notes, photographs and video. We review the available material and discuss the legal and factual issues relevant to the case, rather than drawing conclusions from the charge label alone.

Prepare for the court process

We clarify the next date, identify outstanding disclosure and discuss preparation for Crown meetings or other steps covered by the retainer. Whether a trial is included must be agreed expressly in writing.

Understand a proposed resolution

Before giving instructions, ask about the legal consequences, the terms of any proposal and the alternatives. No outcome can be promised from an initial consultation.

Common questions

Can a paralegal defend a criminal charge in Ontario?

Yes, for certain offences within the permitted paralegal scope. The precise charge and the Crown’s election must be checked. A summary election alone does not make every offence eligible. See the Law Society’s permitted offences.

Will I have to attend court in person?

It depends on the appearance and the court’s directions. Some case management appearances may be virtual. Confirm each appearance with your representative; do not assume a consultation or retainer removes your obligation to attend.
